Drug Offenses

In today’s society, drug abuse and addiction are twin problems that afflict many innocent people. Our society is both overly permissive, with doctors handing out highly addictive opioids like candy, creating unwitting addicts, while at the same time unfairly criminalizing things like simple possession of marijuana.

Many possession charges are often prosecuted as sales and trafficking felonies, based solely on the number of drugs a period interestingly, due to a historical quirk (originating in the ’60s, where hippies would lace sugar cubes and paper with liquid LSD), drug weights now include the weight of the “carrier medium.”

For example, the typical Oxycontin tablet contains 15mg. of the opioid, and 250mg. of an analgesic such as Tylenol. Each tablet thus counts as 265mg., and thus, forty tablets amounts to ten grams – trafficking weight – although there is technically less than one gram of the actual controlled substance involved.

Trafficking charges are always felonies, and often carry minimum mandatory State or Federal prison sentences. Fortunately, an experienced drug defense attorney can help you navigate this difficult area, and is often able to get charges thrown out, reduced, or diverted into treatment programs allowing cases to be completely dismissed, and records sealed or expunged. There are many legal issues involved in drug arrests, including challenges to a search, a search warrant, and other constitutional protections that keep us from becoming victims of the power of the Government.
